The Biden administration is attempting to manipulate the Emergency Medical Treatment and Labor Act (EMTALA) to override Idaho's pro-life law and force emergency room doctors to perform abortions. But EMTALA does not mandate abortion, and in fact, it explicitly requires the protection of "unborn child[ren]."
While arguing before the Supreme Court in State of Idaho v. United States of America, the Biden administration conceded that under the federal law known as EMTALA abortion is never required as the stabilizing treatment for a mental health condition. It also conceded that federal conscience protections ensure that no hospital or individual physician can be forced to participate in abortion.
Both of these concessions differed from the Biden administration's previous arguments, and both are great news. Due in part to the concessions, the Supreme Court did not rule on the merits of the case but rather sent the case back to the lower courts for further consideration.
