The Brazilian Supreme Court gave itself the authority to carry out criminal investigations into “fake news,” defamation, slander, and threats against the honor of the Court in 2019. And a few years later, it began using that authority to demand that social media companies censor disfavored views.
Elon Musk declined to do so on X, and on August 28, 2024, Brazilian Supreme Court Justice de Moraes gave Musk 24 hours to name a legal representative for X in Brazil. Musk did not name a representative because of threats of imprisonment, and de Moraes responded by suspending X for the entire country of Brazil. Instead of recognizing this blatant violation of free speech, the Brazilian Supreme Court upheld the suspension order.
Governments cannot be allowed to force social media companies to censor views simply because government officials disagree with them. Alliance Defending Freedom International requested intervention from the Inter-American Commission on Human Rights, which has jurisdiction over Brazil under the American Convention on Human Rights, to intervene and defend free speech.
